In most rule of law debates, access to the rule of law is not a topic of discussion because these scholars focus themselves solely on the legalistic dimension of the rule of law. Barber was the first to mention the social dimension explicitly but without a theoretical framework. Based on the three (...) capitals of Bourdieu, this paper offers a framework to determine the elements of the social dimension. With these capitals, barriers to the access to the rule of law for individuals can be identified, and solutions can be offered. (shrink)

In recent decades, the general public has become increasingly receptive toward a legislation that allows active voluntary euthanasia. The purpose of this study was to survey the current attitude towards AVE within the Austrian population and to identify explanatory factors in the areas of socio-demographics, personal experiences with care, and ideological orientation. A further objective was to examine differences depending on the type of problem formulation for the purpose of measuring attitude.

Inspired by Jane Gordon's book, Creolizing Political Theory: Reading Rousseau through Fanon, this article examines the paradoxes of Creolization within the French context. How do post-colonial French identities of Maghrebi, Sub-Saharan African or Caribbean descent Creolize French society? Instead of being an opportunity that must be seized by the Nation, why is creolization perceived as an imminent threat to the Republic? How can one think of Creolizing politics in the former colonial power? How does Creolization compel us to rethink how (...) we live together? Sociologue hors normes, Norbert Elias, né en Allemagne en 1897, mort aux Pays-Bas en 1990, est considéré comme l'un des plus grands représentants de sa discipline. Son oeuvre n'a été introduite en France que dans les années 1970, mais bénéficie aujourd'hui d'une reconnaissance internationale et pluridisciplinaire. Pour introduire à cette oeuvre au croisement et de l'histoire, de l'anthropologie et de la psychologie et en restituer l'unité substantielle, Nathalie Heinich dégage d'abord les motifs sous-jacents aux grands travaux d'Elias sur le (...) processus de civilisation et ses choix : la contextualisation plutôt que la généralisation, les relations plutôt que les objets, la neutralité plutôt que le jugement de valeur. Dans le cadre du projet européen Shape Energy, des ateliers multipartites destinés à faire émerger des scénarios autour de futurs énergétiques désirables ont été organisés autour de problématiques locales en partenariat avec dix-sept villes européennes. Revenir sur ces différentes expériences convie à interroger deux des résultats. Le premier est celui de la méthode utilisée, le storytelling. Le deuxième est celui des thématiques traitées et des questions sous-jacentes.

This paper investigates how reticulate evolution contributes to a better understanding of human sociocultural evolution in general, and community formation in particular. Reticulate evolution is evolution as it occurs by means of symbiosis, symbiogenesis, lateral gene transfer, infective heredity, and hybridization. From these mechanisms and processes, we mainly zoom in on symbiosis and we investigate how it underlies the rise of (1) human, plant, animal, and machine interactions typical of agriculture, animal husbandry, farming, and industrialization; (2) diet-microbiome relationships; and (3) (...) host-virome and other pathogen interactions that underlie human health and disease. We demonstrate that reticulate evolution necessitates an understanding of behavioral and cultural evolution at a community level, where reticulate causal processes underlie the rise of synergistic organizational traits. In this paper, I analyse the act of consciousness called empathy, as proposed by Husserl in Ideas II. By applying Husserl’s phenomenological reduction, I evidence three moments that constitute empathy: first, to recognize the other Ego; second, to open myself up to the other Ego; and third, to feel with the other Ego. I investigate these eidetic universalities [Wesenallgemeinheiten] within the limits of pure intuition (HUA III, 146). To recognize the other Ego is an involuntary act that happens in consciousness (...) when I come face-to-face with another human being. To open myself up to the other Ego is a spiritual act derived from freedom. I can decide whether or not to open myself up. If I do not, empathy is interrupted, incomplete, and I can react either affectionately or distressfully, or I can make a hasty judgement and decide either to distance myself from the other or to act. If I open myself up to the other Ego, I can react affectionately or distressfully, without much information. Another possibility is to comprehend, reflect, judge, agree or disagree, and decide either to distance myself from the other or to act in either a compassionate or a confrontational way. In this regard, empathy does not imply agreeing or acting compassionately. In short, I present a mental map of this reasoning and conclude by pointing out the need to develop empathy and the importance of having time to empathise appropriately. (shrink)

This paper discusses the establishment of a governance framework to secure the development and deployment of “good AI”, and describes the quest for a morally objective compass to steer it. Asserting that human rights can provide such compass, this paper first examines what a human rights-based approach to AI governance entails, and sets out the promise it propagates. Subsequently, it examines the pitfalls associated with human rights, particularly focusing on the criticism that these rights may be too Western, too individualistic, (...) too narrow in scope and too abstract to form the basis of sound AI governance. After rebutting these reproaches, a plea is made to move beyond the calls for a human rights-based approach, and start taking the necessary steps to attain its realisation. It is argued that, without elucidating the applicability and enforceability of human rights in the context of AI; adopting legal rules that concretise those rights where appropriate; enhancing existing enforcement mechanisms and securing an underlying societal infrastructure that enables human rights in the first place, any human rights-based governance framework for AI risks falling short of its purpose. Human language, hominin tool production modes, and multimodal communications systems of primates and other animals are currently well-studied for how they display compositionality or combinatoriality. In all cases, the former is defined as a kind of hierarchical nesting and the latter as a lack thereof. In this article, I extend research on combinatoriality and compositionality further to investigations of everyday primate skills. Daily locomotion modes as well as behaviors associated with subsistence practices, hygiene, or body modification rely on the hierarchical (...) nesting of different behavioral and cognitive actions into complex skills. I introduce a scheme which uses hierarchical organization to differentiate combinatorial from compositional skills. Combinatorial skills are defined either as aggregational or linearly hierarchical depending on whether the skill occurs momentarily in space or unfolds sequentially over time. Compositional skills are defined either as nested or interactionally hierarchical depending on whether the skill results in new constructs or in new interactions between existing constructs. The methodology I propose combines epistemological hierarchy theory with data from primatological field research and experimental and comparative psychological research and provides a means to integrate current constructionist and extended views on cognition and action with older research on behavioral logics in psychology and operational chain thinking in anthropology. It is important to understand the drivers of green consumption, because of growing concern for the health of the planet. In this paper, the assumption that a virtue-green product relationship exists is tested. The objective is to understand how product morality can influence the valuation of green products. Relying on virtue theory and positive spillover as conceptual bases, the research implicitly and explicitly tests and confirms green product virtue. The results demonstrate that perceived green product virtue leads to positive emotions, (...) which explain heightened purchase intentions. In line with the conceptualization, I show that the effect is moderated by the importance consumers place on their own morality. Importantly, explicitly framing green products as virtuous activates positive spillover by consumers; when green products are branded with a virtue cue, they encourage consumers to be more virtuous. Beyond being perceived as better people, when consumers interact with green products they effectively engage in more moral acts, such as making donations. The results confirm the perception of green products as moral agents and provide marketers with insights into the marketing value of virtue cues in green product consumption. (shrink)

New definitions are proposed for communication and language. Communication is defined as the evolution of physical, biochemical, cellular, community, and technological information exchange. Language is defined as community communication whereby the information exchanged comprises evolving individual and group-constructed knowledge and beliefs, that are enacted, narrated, or otherwise conveyed by evolving rule-governed and meaningful symbol systems, that are grounded, interpreted, and used from within evolving embodied, cognitive, ecological, sociocultural, and technological niches. These definitions place emphasis on the evolutionary aspects of communication (...) and language, and they are here differentiated from four older paradigms that instead focus either on the referential or social aspects of language, or the informational or semantic aspects of communication. In contrast with these paradigms, the definitions proposed here for communication and language are in line with a pluralistic evolutionary worldview, one that necessitates the recognition that a multitude of units, levels, mechanisms and processes are involved in bringing forth communication and language. Einen Überblicksartikel ausgehend von einer sprachlichen oder geographischen Einteilung zu schreiben ist stets ein kompliziertes Unterfangen und mutet oft künstlich an. Dies trifft zweifelsfrei ganz besonders auf die französischsprachige Rezeption von Hans Jonas außerhalb Frankreichs zu, die ich im Folgenden darstellen will. Auch wenn die Gemeinsamkeiten zwischen den Ländern, die uns interessieren, und Frankreich augenscheinlich zahlreich sind, scheint die Jonas-Rezeption in der nicht-französischen, aber französischsprachigen Welt jedoch ein Spezialfall zu sein.

Bei dem schmalen Buch Zwischen Nichts und Ewigkeit. Drei Aufsätze zur Lehre vom Menschen, das erstmals 1963 erschienen ist, handelt es sich um eine Sammlung von drei wichtigen Jonas-Texten: »Gnosis, Existentialismus und Nihilismus«, »Die Freiheit des Bildens: Homo pictor und die differentia des Menschen « und »Unsterblichkeit und heutige Existenz«. Pour Sartre, l'homme est (...) tout entier libre et responsable de ses actes, sans excuse, et tout entier aliéné, parce qu'il est conscience de monde, position de soi dans une certaine situation - qui n'a de sens que pour une conscience libre. On se propose ici de parcourir son œuvre difficile et dense, de la Transcendance de l'Ego à L'idiot de la famille en passant par l'Être et le néant et Morale et Histoire, notamment. D'abord, la vie politique de Sartre pour dégager la cohérence de ses engagements. Ensuite, sa philosophie de la liberté, la découverte des philosophies de Husserl et de Heidegger, puis l'invention proprement sartrienne, la voie transphénoménale, qui permet de repenser le rapport de l'homme au monde avec le concept de cogito préréflexif, au croisement de la problématique de la liberté et de l'aliénation. Puis on restitue sa compréhension de la genèse d'une société, de l'Histoire et de ses conditions de possibilité, la force des conditionnements mais aussi la marge d'action de toute liberté. Vient après l'histoire d'une liberté en particulier, celle de Gustave Flaubert. A la suite, on traite de la morale et du sens qu'elle peut avoir pour une philosophie de la situation. This paper is situated in the broader context of an examination of the relationship between East and West from the particular perspective of our experience of the body. It is therefore based on two specific traditions, one belonging to the East - a particular strand of Tibetan Buddhism - the other to the West - the Orthodox tradition of the heart prayer - in order to try to show the similarities and differences in their approach to the body and attempt (...) to compare them in the light of their respective ‘phenomenology’. In this sense phenomenology, as a western philosophical discipline, plays a pivotal role in this comparison and hopefully helps to bring new light to bear on this investigation. The early Eastern church evokes the concrete experience of the body as a holy body and sees it as an exemplary route to deification via the mystical practice of the ‘heart prayer’ (hesychasm). As regards Tibetan Buddhism, it advocates the gradual experience of the body as a rainbow body, defined as a path towards illumination, by means of ‘sitting meditation’ which brings liberation in bardo. In order to carry out this analysis, I shall refer to two recent books that are authorities in both these fields, Corps de mort et de gloire, Petite introduction à une théopoétique du corps by O. Scholarly opinions vary on what language is, how it evolved, and from where or what it evolved. Long considered uniquely human, today scholars argue for evolutionary continuity between human language and animal communication systems. But while it is generally recognized that language is an evolving communication system, scholars continue to debate from which species language evolved, and what behavioral and cognitive features are the precursors to human language. To understand the nature of protolanguage, some look for homologs in gene functionality, (...) brain areas, or anatomical structures such as the supralaryngeal vocal tract; others point toward primates, their gestural, vocal, multimodal, and in later evolving hominins also their pantomimic communication systems; and still others draw parallels between the musicality that characterizes language and the pitch found in the numerous sounds produced by animals. Accordingly, protolanguage theories today are multiple and diverse, and protolanguages might have also been diverse. This special issue on Evolving (Proto)Language/s for Lingua bundles several of the protolanguage theories that were put forward at the sixth edition of the Ways to Protolanguage conference series, held at the Calouste Gulbenkian Foundation in Lisbon, in 2019. Not aimed at surveying all the different ways there are to conceptualize, study, and model protolanguage/s, this issue provides interested readers with good overviews on the role played in current theorizing on protolanguage/s by (paleo)anthropology, genetics, physiology, developmental, evolutionary, ecological, and pragmatic research lines. The explanatory power of structures in analytical sociologists’ agent-based models brings into question methodological individualism. We defend that from an explanatory point of view, the syntactic properties of models require semantic conditions of interpretation drawn from a conceptual research framework; in such a framework, social/relational structures have only partial, explanatory power ; and taking the explanation further through generative mechanism modeling necessitates calling upon methodological individualism’s generic framework of interpretation that relies on social actors’ rational capacity. Research on the influence of industry on chemical regulation has mostly been conducted within the framework of the production of ignorance. This special issue extends this research by looking at how industry asserts its interests––not just in the scientific sphere but also at other stages of policy-making and regulatory process––with a specific focus on the types of tools or instruments industry has used. Bringing together sociologists and historians specialized in Science and Technology Studies, the articles of the special issue study (...) the arenas in which instruments and practical guidelines for public policy are negotiated or used. The aim is to observe the devices in the making or in action, from the selection of actors to the production of thresholds, criteria, and other technical regulations. The introduction highlights how industry influence on expertise and regulation is undoubtedly far more pervasive and multifarious than has been conceptualized to date by social scientists. Putting this issue back at the heart of both the STS and social sciences research agendas is increasingly urgent and could lead to new inquiries able to highlight these logics even more widely, using fresh empirical examples. Cornelius Castoriadis is one of the very few social and political philosophers – modern and ancient – for whom a concept of imagination is truly central. In his work, however, the role of imagination is so overarching that it becomes difficult to grasp its workings and consequences in detail, in particular in its relation to democracy as the political form in which autonomy is the core imaginary signification. This article will proceed by first suggesting some clarifications about Castoriadis’s employment of (...) the concept. This preparatory exploration will allow us in a second step to discuss why the idea of democracy is closely linked to tragedy, and why this linkage in turn is dependent on the centrality of imagination for human action. In a third conceptual step, finally, we suggest that any concept of imagination will need to take into account the plurality and diversity of the outcomes of the power of imagination. Thus, the question of the nature of the novelty that imagination creates needs to be addressed as well as the one of the agon in the face of different imagined innovations in a given democratic political setting. As a consequence of this shift in emphasis, to be elaborated further, one will be able to say more about one question of which Castoriadis was well aware, which he never addressed himself in detail, though: the decline and end of polities and political forms, the question of political mortality. Murayama and Jach offer valuable suggestions for how to integrate computational processes into motivation theory, but these processes cannot do away with motivation altogether. Rewards are only rewarding because people want and like them – that is, because of motivation. Sexual desire is not primarily a quest for rewarding information. Elucidating the interface between motivation and cognition seems a promising way forward.

In the 1990s, Building Information Modeling (BIM) software significantly altered architectural approaches to planning and building. Based on parametric methods, BIM technologies sought to simulate the construction process prior to a building’s realisation. These computer simulations challenged the existing practice of representing a building through plan, section and elevation, proposing that one computational model could create a more efficient way of building. The history of BIM explorations and applications, while hardly linear, can be traced back to developments in computing since (...) the post-war period. This article maps some of these histories by examining how the computational model became an organisational infrastructure, collecting data about design and building parameters, and facilitating knowledge transfer across industries. Special attention will be given to the foundational role of Charles Eastman’s work on a Building Description System (BDS) in the 1970s, as well as Robert Aish’s contribution to RUCAPS, one of the earliest applications of Building Modeling for the design of parametric structures. I will further address research on interface technologies and computational curve modelling as well as the popularisation of Building Information systems through the office of Gehry Partners. By highlighting the interrelated nature of technology and cultural shifts in the making of BIM, this contribution sheds light on the epistemic status of computer simulations in architecture, and the dynamics of the design and building processes in which they are used. L’objectif de cet article est de proposer une mise en perspective de la transformation de l’offre médico-sociale amorcée en France depuis 2017 à l’aide des travaux en management public. Nous partons de la proposition que ce virage inclusif présuppose une nouvelle forme de production de l’action publique où les usagers co-construisent la valeur publique (Osborne et al., 2022). Cette conceptualisation de l’action publique soulève de nombreuses questions, parmi lesquelles la façon dont les acteurs vont gérer les conflits, à savoir partager (...) leurs représentations pour co-créer de la valeur. Afin d’illustrer notre propos, nous présentons les premiers résultats d’une étude terrain où, dans une posture de chercheur praticien, nous avons observé et mené des entretiens auprès des cinq membres du bureau d’une association française portant une offre d’habitat inclusif. Les conflits mis à jour nous permettent de révéler que la transformation de l’offre, au-delà des objets qui en sont issus, soulève des enjeux autour des sources de pouvoir et de leur évolution lors du processus de co-production, que nous appelons à mieux décrire dans les recherches en management public. While methodological individualism is a fundamental approach within the social sciences, it is often misunderstood. Das Problem der Sicherung von”Ethics in Public Service“ist in den vergangenen Jahren verstärkt ins Bewusstsein der internationalen Öffentlichkeit gedrungen. Bemühungen und Diskussionen um ethische Regeln und Standards haben dementsprechend Konjunktur. In diesem Buch werden Erklärungsfaktoren für die Einführung von Ethik-Maßnahmen in einem theoretischen Konzept systematisch zusammengeführt. Anhand eines dreistufigen Modells der Nachfrage nach Normen, ihrer Funktionen und des Angebots an verfügbaren Normen wird untersucht, warum und mit welcher Zielsetzung welche Ethik-Maßnahmen wann und wo eingeführt wurden. Grundlegende theoretische Annahme ist, dass (...) Personen in öffentlichen Ämtern und Mandaten in einem Treue- und Legitimationsverhältnis zum demokratischen Souverän stehen, welches sich als eine Kette von Principal-Agent-Beziehungen modellieren lässt. Empirisch wird das Modell entwickelt aus einem Vergleich der so genannten”Ethik-Infrastrukturen“- also des Bestandes an Normen und Regeln, die das Verhalten von Abgeordneten, Exekutivpolitikern und Verwaltungsmitarbeiter regeln - in Deutschland und USA. Korruption und Skandale spielen hierbei eine entscheidende Rolle, aber auch die politische und administrative Kultur eines Landes sowie die Setzung internationaler Standards. The first, “Neglect of Everyday Aesthetics,” speaks of the fact that although the question of aesthetics has been enriched and enlarged by objects long ignored, with notable design, aesthetics is essentially a discourse on art. This is problematic in the sense that many implications of our aesthetic judgment escape all problematic reflexion if we stay centered on art. There exists a fundamental convergence between some major trends of modern epistemology—as outlined, for instance, by Filmer Northrop and Henry Margenau—and the theories actually developed within sciences of the human mind where two types of thought—one implicit and, the other, explicit—tend to refer to two different lines of development. Moreover, these theories can find in the psychology of Lev Vygotsky some seminal hypotheses of a major importance. In order to highlight this convergence, we parallel the role played by structured conceptual (...) systems in Vygotsky’s conception of intellectual development and Northrop’s epistemology. We show how these conceptual systems account for the notion of causality and can explain the success of scientific thought, i.e. its possible match with the real world, while this match falsely justified an overall biological model of intellectual development in Jean Piaget’s work. We conclude that dual process theorists should no longer neglect cognitive tools, and especially conceptual systems, which underpin the awareness and mastery of thought that are characteristic of type 2 processes. This whole analysis leads us to maintain that human psychology is not characterized in the first instance by a need to act, but a quest for meaning. (shrink)

Nous nous intéressons au dispositif d’écoute par webchat d’une association d’accompagnement de personnes en détresse. On se focalise sur certaines régularités du corpus, retenues en raison de leur fréquence, mais également, en raison de leur contribution à la compréhension du fonctionnement de cette pratique numérique et des enjeux de l’expression et de la co-construction de la souffrance dans ce dispositif. Ce webchat est analysé comme un dispositif spécifique de dévoilement de soi laissé à l’initiative de l’appelant mais alimenté par l’empathie (...) et l’humanité de l’écoutant. L’expression de cette empathie passe par une objectivité montrée fonctionnant comme forme de respect de la liberté de penser et d’agir de l’autre et par la routinisation, notamment l’analyse d’un patron discursif, qui amene le locuteur à quitter le champ des valeurs sociales collectives morales pour ce qui est bien, utile ou bon pour lui, individuellement. Cette contribution s’intéresse au statut de l’aidant dans l’accompagnement non professionnel de patients atteints de la maladie d’Alzheimer. Nous envisageons le rôle de la maladie et la fonction du proche impliqué dans une relation d’aide ainsi que leur construction sociale, politique et sanitaire à partir des sciences du langage. Il s’agit de contribuer complémentairement aux professionnels de santé, à la compréhension d’une problématique urgente, l’accompagnement de la fin de vie, par l’une de ses manifestations dans différents espaces discursifs. Nous définissons (...) d’abord la problématique de l’aidance pour étudier à l’interface d’une analyse sémantique de mots (Sémantique des possibles argumentatifs) et d’une analyse linguistique des discours comment les discours (dictionnairiques, juridiques et médiatiques) disent et construisent l’activité d’accompagnement du malade. Il s’agit de mieux comprendre comment les aidants vivent cette expérience dans leur relation au malade, aux instances impliquées dans l’aide et dans l’espace social proche ou éloigné. En questionnant ainsi ce que font les mots dans le vécu des acteurs, depuis le choix des dénominations imposées par les discours juridiques jusqu’aux stratégies pour parler de l’aidant dans les discours médiatiques, nous interrogeons également leur adéquation à la reconnaissance d’un rôle social désormais incontournable.
